Abstract


Detection system is one of the coercive powers of a nation’s centralized embodiments, It will deprive the criminal suspects’ human rights as part of the cost, so the study on detection behavior has always been a hot spot of the theoretical research, the Encouragement Detection which is related to the conflict between public and private rights, has caused widespread concern. The author intends to take advantage of the constitutional theory, to analyze the specific control rules of Encouragement detection, hoping that we can closely combine the abstract constitutional theory ,the specific process control, and the rule of law development with the improvement of measures .Then we should evaluate the value of Encouragement Detection comprehensively and objectively ,neither we can exaggerate the value of fighting against crime , nor we can solely emphasize the objective protection of human rights , whereas search a reasonable balance between the two ideas which are in conflict, and establish a control role of encouragement detection procedure , which has a appropriate clear scope , definite target, an appropriate limit of behavior and the specific illegal consequences .
