Abstract


Defensive medicine behavior (defensive medicine), it was also translated into acts of self-defense medicine and was first put forward by Tancredo LR and other scholars in Science magazine on the "The problem of defensive medicine" in 1978 in the United States. The concept of defensive medicine has not yet conclusive, but we all think defensive medicine behavior is a result of physician’s self-protection. In all ages doctor take a variety of defensive medical treatment in order to obtain exonerative evidence and the opportunity. However, today such medical treatments are more and more obvious with the growth of human rights awareness in patients, bringing the problems and the consequences are becoming increasingly prominent.Through comparative analysis of scholars’different understanding on the concept of defensive medicine behavior, the author official brings forward the concept of defensive medicine. From the research of its concept and characteristics to proceed, through the knows of development status of the China-US defensive medicine, the author discuss the classification criteria foundation of defensive medicine, classification criteria and the specific categories will be brought into unification and standardization. Combining with clinical practical case, phenomenon with regard to medical consent forms as part of its special legal immobilization will be in-depth analyzed. From a moral and legal point of view, according to read the defensive medicine, bringing forward the existence of defensive medicine at a certain period of time is reasonable. However, for ethical requirements it must be bound by the principle of optimal; legally, defensive medicine substantially is a special kind of medical tort, it goes against the bounden duty of care physicians.Thus, in the end the author sets forth preventive measures for defensive medicine, in order to solve the fundamental problem, it is necessary to investigate from the real-time status of implementation of defensive medicine。Through empirical investigation and studies by Chinese and American defensive medical for comparison, it is putted forward the feasible recommendations during carrying out defensive medical treatments in our country. Only in this way supervision and management mechanism and legal system with China’s national conditions defensive medicine can be set up.
