Abstract


Medical disputes are inevitable because of the natures of medical treatment, specialization and high-risk. In recent years, the number of medical disputes which become the focus of the community, is rising with the increase of patients’ rights. Doctor-patient conflicts intensified degree of mutual trust between doctors and patients. This also created the "Medical alarm" and other ugly social phenomena, which severely affected the social harmony and stability. If there is no effective medical dispute resolution, it will lead to more conflicts and more serious social crisis. Effective solutions to medical disputes, is not only a professional issue, it is also a social problem. Harmonious society is inseparable from the harmonious relations between doctors and patients, and effective to resolve medical disputes in advance harmonious relations between doctors and patients. Therefore, through the dispute settlement mechanism of current medical research, which is not only theoretical significance, but is also great practical significance.This article is divided into five chapters, the first chapter is an introduction, this part discusses the research background, significance, condition and current domestic and foreign research contents and methods of this study. The second chapter ,which is from the perspective of medical dispute settlement mechanism of the current "medical trouble" phenomenon, analyzed the cause of the current "medical trouble" phenomenon. The third chapter is based the analysis of the problem of the current medical liability insurance in China, then from adverse selection and moral hazard analysis of the two aspects in the operation of medical liability insurance problems, which result in China’s medical liability insurance obtained underlying causes of poor running. The fourth chapter is the focus of this paper, mainly from the perspective of motivation theory to analyze incentives Ningbo method to arrive at the current solution,which has been well run Ningbo internal incentive mechanism. Chapter Five is the conclusion part of the analysis of previously obtained by the medical dispute shortcomings Ningbo solution, proposed on the basis of its targeted policy recommendations.Through this analysis, the good medical dispute resolution mechanism for resolving current medical disputes is of great significance. But fundamentally ease the current tense relationship between doctors and patients, we have to start from the roots, it is said that we have to do well in advance prevention mechanisms.
