Abstract


Due to global warming , resource depletion, environmental pollution , such as the emergence of the global environmental crisis , and the stimulation of the financial crisis in 2008 , the New Energy and Industrial Governments vigorously support the industry . Countries greatly enhance efforts to subsidize new energy , a variety of the form of subsidies . Under WTO rules , part of the subsidy policy caused the dispute . New energy subsidies for environmental protection so that the presence of a certain legitimacy , but at the same time it needs to be a reasonable regulation . The first chapter describes the relevant national legislation of the new energy policy and subsidy Overview , mainly involving the United States , European Union, South Africa , India and China policy , the new energy subsidies widespread , which leads to new energy subsidies with WTO rules , especially subsidies and Countervailing Measures Agreement ( SCM ) of . The second chapter analyzes the relationship of the new energy subsidies and the WTO regulation of subsidies . Definition of subsidies under the new energy subsidies and SCM , the type of comparative analysis , draw new energy subsidies and SCM rules exist the possibility of conflict . The Chapter from necessity and rationality angle demonstrate the legitimacy of the new energy subsidies . New energy subsidies help to promote the development of environmental protection industry , in line with international environmental law , WTO law about the purpose of environmental protection . In addition, the rise of the concept of environmental rights is the justification for the new energy subsidies . The fourth chapter analyzes the coordination of relations with the legitimacy of the new energy subsidies with WTO rules . On environmental protection subsidies through the analysis of GATT Article 20, the terms of the general exceptions , SCM 8.2 (c) applies to the possibility of new energy subsidies drawn exceptions to the possibility of new energy subsidies under WTO rules . However , if the new energy subsidies over a certain limit, a disguised restriction on trade means , you need to be reasonable regulation .
