Abstract
Securities , futures market since its inception, there has been a lot of problems . Insider trading in recent years , the phenomenon of frequent , seriously disrupting the securities , futures market order, impair the legitimate rights and interests of the majority of investors . With the continuous development of the securities and futures markets , insider trading may face more updates of the situation is urgent to strengthen the legal regulation of such activities . Specifically , the paper is divided into the following four parts : the first part , the crime of insider trading overview. This section briefly from the legislative history of the crime of insider trading , the concept of the crime of insider trading , the nature of the crime of insider trading forth by Criminal \the sin concept contending the author put forward their own views . Second part of the composition of the crime of insider trading . I constituted in accordance with the criminal law criminal pass , starting from the object, objective aspects , the main body , the subjective aspects , a detailed analysis of the composition of the crime of insider trading . Which focuses on controversial issues , such as \Through the above research , the more clearly the various aspects of the crime of insider trading . So as to achieve the targeted propose suggestions for improvement for each negligent . The third part , the judicial determination of the crime of insider trading . This section focuses on insider trading charges Zuiyufeizui , the boundaries of this crime and other crimes . The crime of insider trading a crime number , the existence of the accomplice problems listed separately . I hope that the above study , to achieve clearly defined the purpose of the crime of insider trading . This also helps the regulation of the practice of insider trading . The fourth part , the crime of insider trading legislation negligence and legislative proposals . By comparing the the legislation status quo of China on the crime of insider trading with foreign countries and China 's Hong Kong , and Taiwan law to identify the deficiencies in our legislation at this stage , the experience of advanced countries , and improve our regulation of the crime of insider trading .
