Abstract


The rule of law and building a socialist country ruled by law , has become the development direction of the State based on the rule of law and building strategy . With the constant improvement of the country's legal system , the public awareness of rights continue to be enhanced , as the thinking of the most active university student groups , and naturally they are also increasingly concerned about the protection of their rights and achieve . Although the field of education has initially formed a relatively orderly educational legal system , but the current requirements of the higher education legal order and the rule of law in countries still have a gap. Legal rights can be divided into the substantive rights and procedural rights in the litigation between the college and its students , the university management procedures illegal , students can not fully enjoy the procedural rights to reflect more widespread problem , it is precisely because lack of procedural rights of students in university management , so that the student 's substantive rights have been infringed . Therefore, the recognition and protection of procedural rights of college students , the community , university , student , etc. to concern the procedural rights of the students , is conducive to the protection of the substantive rights of college students . In this paper, the literature survey and case studies to analyze the procedural rights of the status quo of college students , and to further elaborate on the specific content of the right to information , the right to a hearing , the right to appeal , the right to participate and other procedural rights and the status quo , and proposes that the university students lack of procedural rights . Multi-angle , deep-level constraints and procedural rights guaranteed college students to explore , which pointed out that the Education imperfect legal system , lack of norms , the lack of ability of student activists and other external conditions of the university management is unable to protect college students procedural rights of the main constraints . Finally, from the procedural protection of the rights of China 's college students , operational countermeasures and suggestions to enhance the awareness of the rights , create defenders environmental and perfect the system construction , building security system . This not only helps to enhance students' awareness of rights , and effectively protect the rights of students , more conducive to further promote the University by Law School , and also the objective needs of building a harmonious campus .
