Abstract


Suddenly, such as spring night, pirates across the Gulf of Aden. Since 2008, the growing concern for the global Somali pirates still active in the Horn of Africa. Although the UN Security Council adopted a number of resolutions to increase piracy crackdown, countries have also sent warships to escort, but the incident of piracy in the Gulf of Aden despite repeated prohibitions. In view of this, I select the Somali pirates in International Law Perspective \The sound of pirate law to provide inspiration and reference. This paper is divided into five chapters. The first chapter is an overview of the activities of the Somali pirates. Analysis of the historical development of the Somali pirates, the the features extremely rampant reason, as well as the impact of piracy on the world. The second chapter describes the recognized international law on piracy, as well as its limitations faced by the Somali pirate problem. Piracy and the threat to maritime security behavior identified by the United Nations Convention on the Law of the Sea and the SUA Convention, as well as analysis of the limitations faced in dealing with the problem of Somali pirates, provide the basis for the new situation of piracy to redefine . The third chapter describes international law to punish piracy norms as well as its limitations faced in dealing with the problem of Somali pirates. Also through the cooperation obligations mentioned in the \its defects. The fourth chapter describes the role played by the punishing Somali pirates suggestions for improvement of the international law and international organizations in the fight against Somali pirates. The UN Security Council, the International Maritime Organization, the International Criminal Police Organization, for example, learn through Asia on Combating Piracy and Armed Robbery against Ships cooperation agreement provides for the punishment of the Somali pirates. The fifth chapter describes the sound of strengthening countermeasures punishing pirates legal aspects. Through the analysis of existing domestic law, combined with the Somali pirates to punish domestic legislative status quo as well as other countries, China's criminal law, the terms of the creation of the crime of piracy and maritime counter-terrorism legislation to strengthen multilateral cooperation mechanisms weights immature expectations can be defined as the start after in-depth research.
