Abstract


Now, how to correctly determine the legal nature of virtual substance has been a hot issue in theory research, because some cases about net games have become the focus of the discussion. These all depend on how to determine the nature of the virtual substance. This article is about to analyse the nature of the virtual substance in order to do something helpful to solve these real disputes.This article mainly divided three parts.The first part is to confirm the economic value of virtual substance, which is to lay a theoretical foundation for legal property nature of virtual substance, and to provide theoretical and factual basis for legal protection of virtual substance.The second part is to further analyze the virtual property characteristic. This is the main part of this article, and it contains five aspects. First, nowadays some scholars have paid attention to these phenomena and have written some articles to discuss it, and my mission is to find their merits and demerits. Second, learn from foreign countries. Third, analysis of the judical practice about virtual substance. Four, analysis of the contract between the users and the providers from the End User License Agreements. The end, summed up the situation of the study on virtual substance.The third part is to confirm virtual substance is some kind of debt certification, and has analyzed the legal relationship.
