Abstract


Virtual property is with Internet constant development emerging new product. Recent years abroad virtual property legal protection issues more depth study and has legislative, judicial formed for this problem legal protection mechanisms. Virtual property related research still infancy, for virtual property concepts, legal attribute, protection mode exist more disputes judicial practice resolve virtual property disputes legal basis confusion. Virtual property protection not only to developers, operators, users interests also relations entire virtual industries and Internet industry benign, rapid development. Since the existence of virtual property in the short time in China, with supporting laws and regulations are not sound, and virtual property has the unique characteristics of the traditional legal theory and challenges, therefore, triggered a series of virtual property law circles in the rightly attention.In this article uses the method of comparative analysis and case analysis, the basic theory of virtual property from the start, characteristics, property attributes, the traditional property and virtual property, similarities and differences between the areas of analysis, clearly their legal property. In the study abroad legislation general provisions and judicial practices based on virtual property disputes type as a starting point, that our virtual property protection problems that our current response to the current property laws and regulations to improve, and from legislative, judicial and other aspects of virtual property protection measures for virtual property provide multi-angle protection.
