In recent years the house has become a major issue for Chinese people, all the people are turning around the house, which has become a spectacular scene, especially when a new real estate begin to sale, queues waiting overnight become commonplace. However, Chinese people has accustomed to these things, which contains a lot of problems.Bad estate developers lose trust to buyers and rights and housing quality defects are the most. Besides, mortgage disputes as well as government’s absence or abuse of the real estate industry regulations during the buying are also very common. In light of the controversy, the pre-sale system of real estate is widely criticized. People turn to blame the pre-sale system of real estate for the high prices of real estate. They believe it is the pre-sale system which has brought huge profits to estate developers while jeopardize the interests of apartment buyers. This article is based on concerns of both academics and plain people of he pre-sale system of real estate.This paper discuss the complex system of pre-sale of real estate sale from the point of real estate developers, buyers and banks providing mortgage loans, pay attention on various problems that may exist of the parties involved in the main process of pre-sale and propose solutions to the problems. In addition, considering the reality of our country, government plays a very important role in supporting the development of real estate and housing system reform, so I put a sole part to introduce the responsibilities and obligations of government departments during the process of pre-sale of real estate. Forming a system which is on the base of formulating macro policy by the government and the three parties observing laws of real estate industry to solve the problems of the pre-sale system of real estate.
