Abstract


Discretion is the basic form of the exercise of power Prosecutor . Discretion prosecutors investigate the nature and characteristics inseparable from understanding the nature of prosecutorial power , currently there are different understanding on this issue . Prosecutor's discretion , there are two basic modes : Prosecution and prosecution doctrine of legalism . Countries in the world on this issue common practice is to combine the two modes . Prosecutors Discretion of the status quo is not optimistic, looking from a narrow range of legislative status , single species ; see also from the practical situation is artificially restricting the use , can not play an active role. The face of increasing crime , giving prosecutors greater discretion , will become China's procuratorial reform trend. Meanwhile, prosecutors in the expansion of China in the future on the basis of discretion , but also perfect for prosecutors discretion and restraint mechanisms .
