Identity system as a to improve litigation efficiency, increasing the important system of litigation benefits, by most countries in the world focus on theory and practice. , however, because of the influence of the traditional litigation idea in our country, the restriction of functions and powers doctrine lawsuit mode, the application value of neglect and lack of effective system security, the system of identity in our country, there are misunderstanding and confusion with the avowed object properties on the identity, believes effective legislation on disability and inadequacy, this and our country civil litigation activities effectively, and the current civil procedure reform is not consistent. Therefore, this article on the basis of deep analysis on system of identity, through the two big law system of main countries and areas deemed the comparison method, analyzed the China identity system defects in operation and its causes, this paper puts forward the ideas of reforming and constructing our country civil identity system, namely changing ideas, constructing identity on the legislation system, support system of identity on the program.
