Abstract


Profound development of the Internet , quickly changing the life of the community as a whole , it appears also triggered a series of new problems , the domain name is one of them . The domain name as the house number of the network era , in recent years , a surge in the number of domain name disputes , to strengthen domain name protection heard the voices , but the lack of convincing through academic domain is involved in many other issues that the existing law needs to be improved . The purpose of this paper is that the construction of the right to the domain name system , called for China to strengthen the legal protection of the domain name , and improve the legal and institutional . The paper is divided into four parts . The first part is an overview of the domain name , devoted to the classification and composition of the domain name , and introduced the basic knowledge related to the domain name . The second part focuses on the function and value of the domain name , focused on the domain name address both function and labeling function . The third part of the domain name for a brief discussion and loss . The fourth part is the focus of this article , this part of the in-depth analysis of the current debate on the right to the domain name . Affirmed the independent establishment of the value of the domain name rights to the domain name dispute and domain name disputes behind the conflict of rights was discussed . For the nature of the domain name rights , various academic point of view , this paper analyzes the absence of these theories ; and on this basis that the essential attribute of the domain name is : the domain name is a network era of the emergence of new object . Then , this article from the concepts and features of the intellectual property legal system , the analysis pointed out that the domain name has a distinct IP properties, and that the rights of domain name rights emerging as the Internet age , should be included in the scope of intellectual property rights . Domain name rights , however , has many of the characteristics of the personalized , so that it is different from the various existing rights in the intellectual property system ; Therefore, the right to the domain name is a new right in the intellectual property system . Since then, this article analyzes the characteristics of the domain name rights , and the definition of the concept of the right to the domain name and domain name rights were discussed .
