Abstract


Real estate law is the important part of the law of property ,and the system of registration for real estate is the core of real estate law .There are some regulations which is rather scattered in our country .And also there is no systematic research for real estate so that some practices are on the country of the principles involving registration for real estate .This paper tries to do systematic research on the theory in the field of real estate registration .So some efforts shall be given to make perfect the system of real estate registration in our country .This paper have three parts, the main contents are:The first chapter is about the elementary theory on the real estate registration system. This chapter first introduces concepts of the real estateand the real estate registration; Next has discussed the nature of the realestate registration from aspect of the real estate registration behavior andthe real estate registration potency,advocates that the real estate registration has the civil law attribute primarily, also has the secondary public law attribute; then this part analyzes the public-believe power of the real estate registration, points out that its essence is to protect the litigant’s faith benefit, and elaborated necessity to entrust with the registration by the public-believe power; Finally this part introduces thereal estate registration potency,and analyzes the advantage and disadvantages of each kind of registration system by the method of comparison, the goal is to find a registration pattern conforms to our country actual situation, for reference.The second chapter is about the history and the present situation of our country’s real estate registration system.The third chapter is about the constructing and consummation of our country’s real estate registration system.
