Abstract


Guarantee the legal system in China has a very special mortgage system - ship mortgage system , it is a ship as collateral security system , so that the system can be applied to the Maritime Law of the People 's Republic of China and the People's Republic of China guarantee Law \The reason for these problems is that these two laws are relatively small ship mortgage provisions and the provisions themselves , there are still some flaws and ambiguities , and even save the provisions of the two laws in some places there is mutual contradictions and legislation theoretical perspectives differ .
