Abstract


The feudal mainstream legal thinking is the different historical periods in China 's feudal society became the legal system guiding ideology , to determine the basic properties of the legal system , and can be legal or even most of the members of the community are recognized and accepted by the ruling class and intelligentsia thinking. In feudal society , the context of the development of mainstream legal thinking very clearly , and it had in the Warring States Qin Dynasty , the Western Han Dynasty in the early and middle Western experienced several major transition , Legalist thinking , Huanglao thinking , Confucianism has become a feudal society dominated mainstream legal thinking, this change is showing obvious stages , and there are certain rules to follow : the evolution of legal thought is always to maintain a high degree of synchronization with the history of the development ; theoretical form of mainstream legal thinking and ideological system shall constantly developed ; mainstream legal thinking must adapt to the Chinese cultural tradition . In addition, the evolution of the mainstream of legal thinking also reflects changes in the value orientation . Have focused on the various schools of legal thought , along with the change of the mainstream of legal thinking , rulers value orientation has changed . Warring States period of the Qin Dynasty , the prevalence of utilitarian value orientation ; early Western Han Dynasty , mighty Naturing value orientation , determine the direction and nature of the practice activities ; emphasis on the moral value orientation throughout the feudal society in Western Han Dynasty after the mid late . Through in-depth study of the the Chinese feudal mainstream legal thinking , we can further deepen the understanding of Chinese feudal legal system content , features , development of the law , thousands of sustained development without disrupting the underlying causes of many problems , and more able to discover China the value of the traditional legal culture , find the development of the internal forces of the modern civilization of the rule of law .
