Abstract


With the rapid development of our economy, society and country community has gradually become the main interface. assuming administrative and autonomy of the dual nature of the function. under the intervention of administrative compulsory, the government and the community’s responsibility is not clear, the relation of guide and being guided, gradually became the leading and being led; community residents to participate in community autonomous consciousness is weak. leading to the community administrative nature grows in intensity, community autonomy is weakened relatively, participation in community construction enthusiasm get weaker and weaker, the community has virtually become the government administrative power extends.In this paper the Chengguan District of Lanzhou city community autonomy has made the thorough investigation, the survey results reflect the administrative theory of law in depth analysis of the constitution of community autonomy, the legal definition of administrative power and the relationship between community autonomy and community autonomous administration gradually is the reason of administration; analysis of community autonomy law is not perfect, existing community autonomy law principal part is not clear, the lack of community autonomous behavior phenomenon; analysis of the residents of legal consciousness is not strong community participation mechanism is not perfect, and other reasons, led to the residents to participate in community autonomy construction enthusiasm is not high. Aiming at the phenomenon, a comprehensive analysis of the autonomous community of the causes of the existing problems, mainly is the administrative leadership of community autonomy, so the color is strong, community residents will not meet, there is a more important one is not independent of community autonomy, community human, material and financial resources, rely on the government, led to the community autonomous subject legal status of more and more weak.Combined with the working practice, this paper puts forward to the administrative power and community relations, and constantly improve the community autonomous laws and regulations, the existing" city residents committee organization law" and some other community law has not been able to adapt the social economy development, it needs to be perfected. gradually know the relations between government and community, extent community autonomy right, make clear respective duty. the problem of community residents’ participation not only put forward to the perfect participation mechanism, but also cultivate the sense of participation of the residents, improve residents’ right consciousness, continuously promote the community autonomous function, which make up the government encountered in soft, better services for the general people.
