Abstract


Under the influence of global warming, the development of human society facesgreat challenge. Therefore developing the low-carbon economy becomes an inevitablechoice. It has become the countries consensus that developing carbon finance is thebooster of low-carbon economy. And to occupied arteries, mastering the pricingcarbon finance is the commanding height of developing low-carbon economy.Using economic,politic and law methods to develop carbon finance, grabbing themarket of carbon finance and then, mastering the pricing of carbon finance are thecentral issue which governments strive for. Our country is the most biggest carbonemission rights supplier, while the development of carbon finance is lag behind, andin the low-end position in the international trading chain of carbon. All of thesemake our country lies in the disadvantage position in the international carbon financemarket. This essay aims to analysis the legal question at home and abroad existed indeveloping carbon finance in our country, raise corresponding legal advice aboutdeveloping carbon finance in our country, which can help us seize the opportunity offinancial innovation and strive for the initiative in finance market.This essay traces back to the international law origin of carbon finance, clarify theinternational law background of carbon finance, define the connotation of carbonfinance clearly and analysis the relation elements of carbon finance law, and at lastexplain carbon finance legally.Generalize the law question at home and abroad existeddeveloping carbon finance in our country by comparing with the current situationcarbon finance at home and abroad, and the legal practice situation; determine theprinciples that should follow in legislation of carbon finance and discuss the mode oflegislation of carbon finance; final advice:a climate change legislation to provide aframework for the development of carbon market,and then raise the law advice aboutcarbon finance development through three aspects which contains perfectingfinancing market of carbon finance,establish the trading market of carbon finance andrisk-control mechanism.It can promoting the change in the economic growth patternour country; it can make low-carbon economy become the new growth points in theeconomic development; it has profound significance on seeking the rights of speak oninternational unity rule making, and pricing on carbon finance market.
