Abstract


Administrative proceedings and criminal proceedings are two separate forms of action , in our current judicial system, the different nature of the dispute within the Court were different from the same courtroom to hear the application of different rules , will inevitably lead to litigation between administrative proceedings and criminal intertwined and may cause conflicts on the outcome of the proceedings , this situation is called administrative proceedings and criminal proceedings related issues . China's existing laws on administrative litigation issues associated with the provisions of the Criminal lack of judicial practice, the handling of this issue is more confusing , resulting in a large number of similar cases deal with diverse, conflicting outcome of the proceedings . Administrative proceedings and criminal proceedings related issues , both showed conflicting associations , and performance of non- conflicting association , its causes are the legal and institutional reasons and other reasons. In Proceedings of human rights , procedural justice and litigation efficiency theory as a guide to Germany, France , Japan and Taiwan, China -related practices learn to raise our academic theories related to the reference , administrative proceedings and criminal proceedings related problems should adhere to the \legal order and social stability.
