Abstract


This article is a paper on the reform of China 's reeducation through labor system , aimed at understanding the current situation of China 's reeducation through labor system and its need for the rule of law and judicial reform , through the analysis of the pros and cons of the current re-education through labor system , and a profound analysis of existing substantive law and procedural law system concept , put forward practical reform programs in order to provide useful lessons for China 's legal construction . This article is divided into five parts , the first chapter from a historical perspective , a brief introduction and study of the history and development of China 's reeducation through labor system and from the application object , the five aspects of the scope , duration , applicable authorities and applicable procedures for re-education through labor the status of a thorough investigation and study . Chapter II made ??history and reality of the effectiveness of combing through reeducation through labor system , affirmed their existence is reasonable ; However, due to their physical and procedural aspects of legality and legitimacy of the problem , it is necessary to the rule of law and judicial reform. The third chapter is an overview about the foreign legal system of reeducation through labor , which mainly describes the foreign misdemeanors system , the security of the penalty system , the juvenile justice system .
