Abstract


Criminal legal aid system refers to a system of legal protection in the course of criminal proceedings, in accordance with the law, financial difficulties or other parties to the case meets the statutory requirements, to provide free legal services. \our current criminal legal aid system since its establishment in the 1990s, after years of exploration and efforts, has gained rapid development. The role of criminal legal aid promote judicial justice, building a harmonious society is growing. But because of the late start, China's Legal Aid System in rapid development, inevitably there are imperfections, also encountered some problems in practice. China's criminal legal aid system, there is the problem analysis and elaboration of points views, combined with the practice of local government legal aid agencies to be beneficial to the further development and refinement of our criminal legal aid system. The paper is divided into an introduction, body and conclusion. In which the body is divided into: The first part is an overview of criminal legal aid. Start with the basic theory to explain the meaning of legal aid and criminal legal aid, then the criminal legal aid system both abroad and in the course of development in China, the criminal legal aid representation model and our exploration and practice, and the Shanghai Pudong mode analyzed. The second part is the analysis of the status quo and problems of China's criminal legal aid. On the basis of analyzing the status quo of China's criminal legal aid, that already exists in our criminal legal aid work in practice actively participate in the development trend of the resolve social conflicts, and then analyze the practical difficulties of this stage of criminal legal aid work and Shanghai Pudong now stage of the main bottlenecks, to pave the way for the next part of the article the further elaboration. The third part is the perfect way to China's criminal legal aid. Improved from two aspects, one from the legislative point of view, it is recommended legislation to improve the status of the criminal legal aid system, to expand the scope of the criminal legal aid and economic hardship standards, legislation to improve our current criminal legal aid system. Second, from the perspective of judicial practice, improve the criminal legal aid to ensure funding to strengthen the supervision of the quality of criminal legal aid practice reform, the existing criminal legal aid system. The fourth part is the Shanghai Pudong experiences and ideas for improving the criminal legal aid work.
