Abstract


Litigation-related petitioning is a sensitive problem, which is always deemed as an issue concerning social stability by the central government while the local governments at all levels making a lot of efforts on the same. However, with the extremist acts taken by a few people when airing their grievance affecting the normal functioning of the judicial departments, abuse of the right to petition has become a challenge facing the authority of the judiciary, and also brings about negative impact on the whole society. Thus there have been heated debates on keeping or abandoning the system of reviewing litigation-related petitioning. The author tries to give some deep thoughts from legal perspective on litigation-related petitioning in accordance with Zhong Fa No.22 (2009) and The First 5-year (2009-2013) Construction Plan of People’s Courts issued by the PRC Supreme Court. This dissertation conducts a thorough study on the relevant concepts in connection with litigation-related petitioning, differentiates letter petitioning and visit petitioning, describes historical changes of litigation-related petitioning, proves the necessity of litigation-related petitioning review, makes a systematic analysis on the reasons for litigation-related petitioning so as to help reviewers quickly focus on the key issues in petitioning, conducts in-depth analysis from legal perspective for the purpose of improving and better positioning the reviewing of litigation-related petitioning to ensure that the reviewing of litigation-related petitioning goes by the laws and regulations, and finally raises constructive proposals on a referential basis.
