Abstract


In a market economy, trade secrets has become the key to success of enterprises based on does not fall. The role of trade secrets is more important is the more urgent the need for its protection. Although the world is the specific mode of trade secret protection laws vary, but legislation to protect the trend continues to grow. China attaches great importance to protect trade secrets. On the ways and means of protection, covering multi-level protection of civil law protection of trade secrets, criminal law protection and administrative law protection. Such protection for trade secret protection, although more comprehensive, but there also more obvious vulnerabilities. This paper attempts to do an analysis of the loopholes in the legal system of China's protection of trade secrets, and want to be able to provide some useful suggestions on China trade secret protection perfection of the legal system. This thesis consists of three chapters. The first chapter focuses on the basic theoretical issues of trade secrets as an introduction, in particular the concept of trade secrets, the characteristics, the nature of the world commercial secret protection mode made some research to pave the way for further discussion below. Chapter II combined with our existing laws, to make some introductory remarks on China's current trade secrets legislation and its protection mode. China's current trade secret protection provisions scattered anti-unfair competition law, labor law, contract law, administrative law, criminal law and other laws and regulations and other regulatory documents. Therefore, this chapter on the protection of trade secrets in China and its specific legislation, especially some of the specific laws and regulations, made a detailed description and analysis. The third chapter proposes recommendations to improve our trade secrets protection legislation. I believe that, under the present conditions, in order to promote the development of market economy, to adapt to the global economy, information integration needs of the times, we should seize the time to amend, supplement the provisions of the Anti-Unfair Competition Law \the contents of the secret specific scope of punitive damages and non-compete provisions.
