Abstract


With the development of the science technology, human’s ability on obtain natural resources are strengthening by means of the power of technology, therefore, the problem of ecological damage and ecological damage become more and more serious. The technology improvement promotes the transform on production mode, the commercial scale is also enlarged, and the consume on resources increases as well, all of which cause more environment problems; on the other hand, the total amount of resources are reducing, the available resources is undersupplied seriously, the resources problem become the bottle-neck in enterprise development limitation. Those enterprisers, which are based on their natural character of "resources dependence", will inevitably face the problem of enterprise development and environment.Enterprises ecological construction is out forward based on the philosophy on enterprise development and ecological problem, which appeared from 1990s. It follows the ecological development law, connects the enterprise and social economic development, emphasis on the benefit the tripartite of "Enterprise-ecological construction-society". The enterprise development should carry out based on ecological security, ecological efficiency and sustainability, aim at realizing of decrement, reutilization and reclamation, encourage enterprises take action on technology innovation, improve the traditional production mode, develop itself into Ecological environment-friendly enterprise gradually. To those enterprises which are resources dependence, influence the environment deeply and widely because the production process of these enterprise are long and the waste (waste water, waste gas, and waste material) that produced from the process are large in scale, these enterprises will face difficulties if the ecological construction and environment problems settlement are not carried on. The enterprise ecological construction encourages the enterprises to settle environment problems from its root, given up the control methods of "pollute first, and then settle it". To an enterprise, the first thing to do is reconstructing the existing industrial technology. During which period, the enterprises is carry out environment construction only by means of entrepreneur’s sense of duty; lacking of external excitation mechanism, it will confine itself to the mire of economic interest:not taking active action on ecological construction. As a result, the practice of ecological construction in western countries has provided us with the template for reference, establish and improve the incentive and restraint mechanisms to guide enterprises to embark on the road to ecological construction.In this paper, it relies on enterprise resource ecological problems as the breakthrough point, analysis and discuss the problems between enterprises rely on ecological construction and legal regulations within Yunnan Province as well as the root of the problem; it discuss the mutual mechanism between enterprises rely on ecological construction and legal regulations in order to point out how the two parties restrict, improve each other as well as develop together under the different history and economic situations in stead of building a perfect law system; at the same time, it combines the status quo of resource rely on ecological construction of the Yunnan enterprises, raise the question of how to improve the interaction between the two channels. To sum up, legal regulations to guide enterprises in the ecological construction has played an important role, encouraging technological innovation, encourage enterprises to build sustainable development as the core enterprise culture; the diversity of enterprise ecological construction practice enrich and deepen the content of the law. The constantly improvement of the mechanism of the law also raised the level of ecological construction; meanwhile, the legal regulation development regulates gradually from the "human→cnvironment" one-way system to "human-the environment-human" two-way development of the regulatory system, which constantly in the run-in Mutual promotion and coordinated development.
