Patented \times patent Law Amendment has not been any changes to it , which in recent years , less and less discussion of novelty . Third repair of the Patent Law in 2008 , but then the novelty of the modifications , expanding the range of novelty , raising the standard of novelty . In view of this I regain previous studies , the combination of the third revision of the Patent Law provisions on novelty and impact , re- discussed the novelty of the patent , and make their own little superficial views and suggestions . The paper is divided into five chapters , starting from the patent novelty source of law , leads to the definition of patentable novelty and patent novelty of some of the problems discussed these issues of patent novelty . Chapter I : Patent novelty overview. By exploring the nature and origin of novelty leads to particular problems in the definition of novelty , the general criteria of novelty and novelty judgment . Chapter II : Patent novelty and regional standards. Analysis of a representative sample of some countries and regions of the provisions of the patent novelty geographical criteria discussed in the third revision of the Patent Law of China on patent novelty regional standards impact problems , and gives the author's point of view and recommendations. Chapter III : Patent novelty with conflicting applications . Review compared before and after modification , impact and issues discussed in the third revision of the Patent Law of China applied for patent novelty conflict , and gives the author's views and suggestions . Chapter 4: Patent novelty and direct replacement of the usual means . Review the practice of doubts and contradictions , discusses the legacy of the direct replacement of the usual means \. Chapter Five: Conclusion . A summary of the discussion and recommendations of the front .
