Abstract


Futures is a commodity economy develops to a certain stage of the product , is now developed on the basis of barter derivative form . Lead futures advance transaction causes of the phenomenon are many, both futures main factors of poor self-discipline , but also the legal system designed to lag factor , as well as futures technical design ( such as margin trading system ) and other factors. Legal authority of the state and society as a means of regulating trade in the futures overdraft prevention and control is particularly important, while China has not yet completed futures legislation. To this end , China's highest judicial authority and the relevant administrative departments issued a number of norms, laws and regulations, the introduction of this series , in large part because of improved laws and regulations lag futures risk events occur frequently environment, but its content is not perfect and the lack of rationality in terms of value . This paper attempts to futures trading phenomenon overdraft depth legal research , focusing on analysis of its legal nature and legal responsibilities , and to evaluate the existing legal norms and recommendations for future legislation to arouse more attention.
