Abstract


Since the opening in China and the feasible policy in the economy in domestic area, the increasing trend of the economic crèmes of socialism market order would be enlarged, especially after the construction and development of the socialism market economy with the magnification of the scale of markets and the multi-range of the market subjects, the various busy economic activities, the complex economic relations, the numbers, the funds and the damages of the socialism market orders breakers are also updated. In this process, the“Marketization”economic crimes as the concept motioned by the moving position, would be closely connect with the development and changes of the markets, the speed and intension of the process of Marketization, which becomes the barrier to handicap the social and economic development. So this paper as one investigation report, tries to summarize the characters and the reasons of the Marketization economic crimes and to put forward the relative policies to limit these crimes as the suggestions by the deepen investigation and researches of County X in Zhejiang Province.The whole text is divided into four parts:Part one is the briefly introduction about the definition of the“Marketization”economic crimes and the meanings.Part two is to summarize the major characters of“Marketization”economic crimes at present by the investigation of County X in Zhejiang Province, which is the following five points: one is that the various sorts, the broaden range and the high-rated; two is that the hot areas with the“character”markets; three is the multiple structure and levels of subjects; four is that the mutual interweaved with the other crimes and the changeable targets; five is that the fact of non-transfer cases by the administrative authorities would be serious.Part three is to focus over the reasons of the“Marketization”economic crimes as the following: one is that the imperfection of the laws and regulations to maintain the market orders; two is that the misapplication of the current penalties in the laws and regulations; three is the obstruction of the local protections to rush up the“Marketization”economic crimes; four is that the imperfect system of transfer cases form administrations to the prosecutors; five is that the low-quality of market’s subjects’educations and the slight idea about the legality.Part four is to put forward the relative policies to limit the“Marketization”economic crimes: one is to cultivate the legal environment for the market economy; two is to enforce the execution and prefect the punishment system to this kind of crimes; three is to rule of law both in inner and outside aspect; four is to enhance the legality idea of market subjects to establish the overall social credit system.
