Abstract


Formally implemented in 2006 the’PRC Civil Servant Law’states:civil service staff of china is composed by seven categories, such as the party’s organs, administrative organs of personnel, etc. Such a provision is no doubt with Chinese characteristics, in consideration of the current status of Chinese political system and the cadre management, and seeing after the historical formation of the national governance structure. However, this composition is controversial. the controversy focuses on two aspects:the first is whether the ruling party, participating parties represented, members of the judiciary authority should be included in the civil service and the second is whether the overall size of the civil service is too large.From the aspect of defining the confine, this paper discussed the reality of China’s civil service and historical reasons and compared to analyse the following three social practical problems. First, find their respective advantages in defining the scope of the civil service in three different patterns. Compare to China’s current composition and then find out the problems in current composition of China. Second, in the aspect of social status, the structure of civil service will promote the official standard idea. Third, in the aspect of civil service administrative efficiency, the overseas civil service can basically achieve single and efficient service, and can implement a more effective administrative supervision. But turn to our civil service, there are still problems of efficiency, and the administrative supervision is not independent. Comparing the above, finally a conclusion can be gotten, that is there are problems existing in the structure of civil service of China.Finally, the paper proposes a vision to improve the composition of Chinese civil service. First, during the process of deepen political reform, improve the set of the civil servants constitute. Straighten out the relationship between party, reduce the number of party cadres in the number of civil servants, strengthen the powers of the NPC, drop the CPPCC and the democratic parties out of the civil service, etc. Second, simplify of the composition of Chinese civil service. Reduce the layers of government, rigorously enforce civil service examination, and speed up financial reform, etc. Third, enhance legal construction, according to the law control the size of the civil service.
