Abstract


Anti-dumping because it can more easily and effectively and directly aim to protect the domestic industry , and is widely used in practice . After joining the WTO , as the international trade competition, how to comply with WTO rules, establish and improve the system of judicial review of anti-dumping , as well as how to grasp the development trend of the system , has become an increasingly important issue. Related research in the country has not deep enough, this thesis has theoretical and practical significance . This thesis chapters , the text of about 40,000 words. The first chapter describes the establishment of judicial review of anti-dumping necessity . The paper first point to understand the anti-dumping in international trade position reflects the practical significance of this writing . The paper also demonstrates the established judicial review of anti-dumping system is China 's anti-dumping practice requires . Then expounded the basic system of judicial review of the case , judicial review reflects a general commonality . Finally, from the perspective of the political and economic analysis of China's accession to the WTO Antidumping Judicial Review of trends and specifically describes the specific content of the system changes will occur . The second chapter principles and legislation from the legislative point of view of the process of two judicial review of anti-dumping build elaborate , and a critical analysis of the existing legislative model . China has established a system of judicial review of anti-dumping cases the judicial review system has its particularity , China's anti-dumping legislation judicial review model has a theoretical basis , in line with the principle of legislation , while there are many deficiencies. The third chapter larger space , comments from six aspects of judicial review of China's anti-dumping system, which six aspects : scope of the case , participants in proceedings , jurisdiction, applicable law , review criteria and trial mode. Comments are described using the first post -assessment and Commentary combination of methods, described is focused on a comprehensive summary of the relevant provisions of the system , analysis focuses on when to express their opinions or make their own suggestions .
