Abstract


With the prosperity of the socialist market economy, the market competition is intense, there is a growing number of unregistered trademarks in China. Become an issue of vital importance to trademark protection on the protection of unregistered trademarks. This article is intended to be discussed protection of unregistered trademarks. Article clarifies the concept of unregistered trademarks, unregistered trademarks reasonable under the registration system, two legal systems of the countries of unregistered trademark protection issues the situation in the unregistered trademark protection facing the plight of China unregistered trademark protection system construction put forward a number of ideas. Unregistered trademarks and registered trademarks identify the source of goods and carrying goods and operators goodwill consistency, as well as in our country unregistered trademarks of the legality and rationality, whether from maintaining market competition order, the protection of commercial investment point of view, or from the pursuit of substantive justice, to make up for the purposes of trademark laws to consider, to deal with these unregistered trademarks render appropriate protection.
