Abstract


Textile trade has always been the backbone of China 's national industry . After accession to the WTO , according to the WTO Textiles and Clothing Agreement and relevant provisions of China's accession to the WTO Protocol on the integration of textile quotas , starting from January 1, 2005 , the original restrictions on Chinese textile exports to the country will be canceled on Chinese quota limit , the corresponding products will no longer be the implementation of the quota license management , this means that the world textile trade will achieve complete liberalization . But at the same time due to the relevant provisions of the People's Republic of China 's accession to the WTO Protocol is not consistent with the WTO Agreement , China has become the the textile export restricted country up , limited the widest range of products , the largest trade friction countries . Legislative defects in the textile industry in China , so that the situation is becoming increasingly serious. Currently, unreasonable to take advantage of some of the international trading system for a number of countries in Europe and the United States on China's international , domestic textile market the fact that the implementation of discriminatory policies , stressing only the exercise of the rights and constraint mechanism has not been established , the resulting textile trade friction , it should be arouse our vigilance . Especially after the abolition of textile quotas in 2005 , in order to better deal with Europe and the United States to China textile safeguard measures and textile trade friction , the development of a sound system of textile trade is imperative . Seeking a reasonable way to resolve legal This paper tries to analyze the current situation of the textile industry to the accession to the WTO after China's accession to the WTO and trade difficulties faced , and for China's textile trade now encounter a variety of trade disputes , friction , a variety of barriers to trade and special safeguard measures , reasonable and effective solution from a legal point of view to explore and discuss how to reasonably use reasonable regulation and protection of the relevant provisions in the WTO rules and principles of China 's textile trade .
