Abstract


As the fifth advertising media after newspapers, magazines, radio and television, web advertisement has shown unique features because of the different Media it based on. The development of web advertisement has shown unparalleled advantages and becomes a great potential economic growth of network development. The web advertisement develops rapidly, accompanied by a series of new problems which not only in the technical level, but also in the legal level. The problems constrain the development of web advertisement itself, and bring great challenges to the management of China’s advertising market and the improvement of the network environment.Currently, the problems of the web advertisement in the development are mainly as follows: the position of the subject is unclear; the content is inappropriate, web advertisement infringement, unfair competition, the regulation issues and so on. Therefore, how to achieve the legal regulation of web advertisement is the important problem which we need hardly to solve. For the traditional advertising, it is regulated mainly by "Advertising Law of the People’s Republic", "Advertising Act Implementation Rules" and“People’s Republic of Consumer Protection Law". However, because of the characteristics of web advertisement, the existing laws and regulations can not meet the needs of its regulation. It is of great theoretical and practical significance to explore the legal strategy of web advertisement, which combined with the existing laws, the legal issues and the forms of web advertisement. Currently, the United States, the European Union and other developed countries have been more mature legal norms and practical experience on the management of web advertisement. We can learn and absorb the experiences of developed countries based on the reality of our country. Then we can explore a more reasonable path to solve the legal regulation problems of web advertisement. The Measures can provide protection to the development of web advertisement and protect the legitimate interests of network users.The article has five parts totally. The first chapter is an overview of web advertisement. This chapter includes the concept, the development, the characteristics and forms of web advertisement, and we can have a clear understanding of it. The main content of the second chapter is the theoretical foundation of legal regulation, and focuses on the theoretical basis and necessity of the legal regulation of web advertisement. The third chapter analyzes the experience and practice of the legal regulation of web advertisement which from the United States, the European Union and other developed countries. We can learn the legislation and practical experience which is worthy. The fourth chapter has two parts. Firstly, it analyzes the legislative situation of web advertisement in our county; secondly, it sorts out the problems which appears in the process to regulate the web advertisement. The content of chapter V is countermeasures. By comparing the foreign experiences, and anglicizing the problems in web advertisement, we can take appropriate measures to regulate our web advertisement.
