Abstract

Anti-corruption has become the common theme for governments of different states to manage their officers. Being an effective implement against corrupt actions, property declaration system for government officials works on prevention, inhibition and punishment of corruption and has become part of the anti-corruption system in most countries. It is an effective way for supervising state officers in a lawful society, as well as a reflection on the fact that the state power belongs to its people. The implementation of such system is a necessity and a must in the process of constructing a harmonious society in China.In the political and cultural progress, it is the inevitable outcome of the development of socialism democracy and market economy.In fact, the "Property Declaration Law" was incorporated into the legislation plan by the Standing Committee of the National People’s Congress in 1994 but has not been laid out yet, though the central government strengthened the ordinary supervision on government officials above county level by issuing "Provisions on Income Declaration for Government Officials above County Level" and "Provisions on Family Property Declaration for Present Government Officials of Provincial or Ministerial Level (Provisional)", which were hard to bring the expected effects because they fell in the category of policy documents rather than regulatory legislation. In 2009, as a practice of local legislation, Alter Government took initiative to put up the payrolls of its government officials on the Internet. This is an important step in the construction progress of property declaration system for government officials in China and has a positive impact on promoting related legislation.Based on the theories of property declaration system, this article proves the realistic significance of the establishment of such a system in China, reviewed the current regulations and points out the existing defects. By introducing related legislations in foreign countries, this article proposes legislative ways to improve the property declaration system in China.
