Abstract

Unsecured guarantees as to the low-income groups in rural microfinance has developed in our country for the past 30 years, made a significant contribution to poverty reduction in China, especially the rural poor out of poverty, and to promote the reform of the rural financial system in China, in the new rural development play an important role. The last decade, our government certainly the cause of rural microfinance makes rapid development, especially in the past two years, launched a series of innovative initiatives welcomed by the market and the demand for rural microfinance microfinance in rural areas. However, due to our current lack of legal regulation of the microfinance, rural microfinance in the development of many difficulties, such as the status of legal subjects is not clear, the internal management mechanism is imperfect, narrow funding sources and the lack of micro-credit project comprehensive regulatory framework, combined with rural microfinance internal management risks and running market risk, credit risk, and the risk of natural disasters, which are hindered sustainable development of microfinance. For the difficulties encountered in the development of micro-credit in rural areas, only it is not enough to rely on our current normative documents. Throughout the Rural Microfinance Development in Bangladesh, Indonesia and other countries, have developed have specially adjusted microfinance specialized legal. Strong advocate of rural financial innovation, we shall, in accordance with China's current rural microfinance development practices, combined with the successful experience of the international rural microfinance, improve the legal system of our rural microfinance, microfinance for rural provide strong legal support. Based on the above considerations, using comparative analysis, the empirical analysis and comprehensive research on the legal difficulties that exist in rural microfinance, and based on our current rural financial development status and microfinance legal norms proposed perfect the legal system of China's rural microfinance ideas and proposals to promote the cause of the steady development of China's rural micro-credit through the establishment of a sound legal system. Along the path of innovation of the rural financial system in China to explore the the microfinance legal system in our country to establish a foothold in China's national conditions. The article is divided into three parts: The first part of the concept of micro-credit in rural areas, the essential characteristics, as well as in the development of our country to make a statement, focusing on rural microfinance encountered on the internal and external risks as well as legal predicament ; second part introduces some countries of the successful implementation of micro-credit programs, pointed out that the successful experience of these countries on China's development of rural microfinance revelation; Part III is the first of two parts on the basis of proposed establishment of microfinance framework of the legal system in our country is envisaged that clear including microcredit body of legal status, the improvement in the running and operation of the legal regulation, the regulatory framework of the microfinance project and rural micro-credit risk-sharing mechanisms.
