Abstract


Ming and Qing dynasty is a period of great turmoil in the Chinese feudal society,the new situation in the social political and economic sphere making the Chinaintellectual of this period presents a colorful scene. Many thinkers and scholarsharbor the world, concerned about the affairs of the prevailing political and puttedforward their own views and perspectives about the economic, legal and otheraspects of the feudalism system. TangZhen is one among them, he witnessed thegreater social unrest and concerned people, he wanted to aspire for the emperor andcared the livelihood for the common people. He proposed many ideological viewsand arguments about the political, economic and other aspects of the legal system.The academia has made a lot of achievements for TangZhens’ political,economic, philosophical ideology, but his legal thought did not have detailedresearch and discourse; Therefore, the author wants to summarize the TangZhens’legal thought systematically based by "QianShu" which is handed down to TangZhen,and summarized the research that is discussed by the previous academic. In theprocess of writing this article, the author researches the period background andphilosophical basis which TangZhens’ legal thought generated. The author detailedexpounds the TangZhens’ legal thought on the basis of the classification aboutmodern law such as Nomology, Economic Law, Administrative Law and AdministrativeLaw, and tries to compare the TangZhens’ legal thought with the legeal thought ofHuangZongxi,GuYanwu and WangFuzhi. Finally, the author conducts an objectiveevaluation about his legal thought in a historical perspective, and indicates theenlightenment of his legal ideology in todays society. TangZhen is a progressivethinker in the Ming and Qing dynasty, as its legal thought inherited the characteristicof the Chinese traditional political and legal thinking, but also had distinctivecharacter. Great enlightenment for todays socialist nomocracy construction can bestudied by TangZhens’ legal thought. But“the night can not be illuminated by theradiancy in a county”, confined to the limitations of period and class, he failed tobreak through the barriers of history ultimately, most of his learnability systems and thinking only stay in the book, but this did not affect the position who is in theintellectual history. In this thesis, the author strives to revert the TangZhens’ LegalUtopia comprehensively and objectively according to summarize its legal thinking.
