Abstract


At present, The mainstays of the Kyoto Protocol are the emission reduction obligations created for Annex B nations, the three flexibility mechanisms, and the provisions for the domestic implementation of Kyoto obligations. The three flexibility mechanisms includes JI, CDM and EI. Kyoto protocol includes Assigned Amount Units (AAUs),Emission Reduction Units (ERUs) and Certified Emission Reductions (CERs). Although Kyoto does not directly implicate trade provisions or contravene WTO rules, it has the potential to impact key sectors of the economy and international trade. Accordingly, the Kyoto Protocol provides an appropriate context for analyzing fundamental tensions between international trade and environmental regimes. Kyoto protocol doesn’t directly involve with violation of the trade rules of WTO, reduce greenhouse gas emissions and promote the sustainable development of the Kyoto Protocol target, conflict with the WTO rules which established by promoting trade liberalization and economic growth . Based on the conflict between the reduction mechanism of Kyoto Protocol and trade rules of WTO, solve the potential conflict. This potential conflict involving emissions trading can as a GATT goods, emissions trading as a GATS service, emissions trading subsidies and domestic policies and measures to implement Kyoto Protocol Provisions. From the principles of sustainable development, solve the emissions trading and Clean Development Mechanism coordination with GATT and GATS, and CDM, Assigned Amount Units,the domestic implementation of Kyoto obligations, environmental taxes , BATs that coordination with the SCM.
