Abstract


The protection of human rights issues of common concern to the international community is to protect human rights issues, to raise the height by constitution. But as is serving a criminal (only studies were deprived of liberty criminals sentenced to criminal detention, imprisonment, life imprisonment, closed the freedom, because of their personal freedom is temporarily restricted by many of its rights to protect human rights groups, the problems of common concern to the whole society is sensitive issues. Because of the criminal rights have rights and the particularity of the human body, the imperfection of the contents and human rights as human rights, in its protection still has many problems to be solved. In the national laws and regulations related to the situation, how to effectively protect rights of criminals is a real problem, so the criminal theory and practice of human rights issues has tremendous implications.From the western human rights protection status quo of criminals are analyzed, and the protection of human rights in criminal standards, and China’s human rights protection status and international criminal comparing the standards of the objective, the protection of human rights in criminal of the current situation and existing problems of the system, elaborated the legal status of human rights, the criminal concepts and characteristics of the human rights of criminals, a rational understanding. In the study of international practices in China, combining the actual practice, the problem of penal execution gives feasible solutions and reality.
