Abstract

In recent years, China's foreign trade surplus continued good momentum, countries, led by Japan, the United States continue to put pressure on China, groundless accusations against the Chinese yuan is undervalued, to revalue its currency. The Chinese government since July 21, 2005, based on market supply and demand with reference to a basket of currencies, a managed floating exchange rate system, the exchange rate of the RMB against the U.S. dollar appreciated by 2%, this approach to some extent alleviated RMB appreciation pressure on the RMB exchange rate issue accusations and making things difficult, not this died down. In 1985, the United States has put pressure on Japan to revalue the yen, and eventually led to the signing of the Plaza Accord. So far, the \Today, the United States will focus turned to China to revalue its currency, faced with the same situation in 1985, China's ability to withstand pressure, to insist on the autonomy of monetary policy is the concern that the problem. Learn through the analysis of its lessons on the \the accused and not on the basis of international law, it is necessary. This paper mainly discussed from the following aspects: First, the first chapter introduced the reform and development of China's RMB exchange rate regime and the United States on the origin of the RMB exchange rate legal dispute. Secondly, the second chapter in the perspective of international law, look at the controversial law proposed by the United States on the RMB exchange rate, summed up the two legal points at issue, that the United States may be raised as a potential claimant \\This chapter analyzed the relevant provisions on the exchange rate on the IMF and the WTO China's RMB exchange rate issue is the issue of sovereignty of a country, China's current exchange rate is not as good as the United States said to be manipulated, nor does it constitute a so-called \No unwarranted charges and interfere with the powers of the RMB exchange rate issue. Finally, the fifth chapter propose to repeat Japan's mistakes in order to prevent the appreciation of the renminbi, we must insist on the autonomy and independence of the exchange rate system, the establishment of the financial risk prevention system to guard against the opening of the capital account, to strengthen capital regulation; accelerate the domestic industrial structure adjustment, expanding domestic demand; revise and improve the current system of rules of origin, and to reduce the Sino-US trade friction through both international and domestic.
