Abstract


With the development of society, the product is getting rich countries to continue to develop and improve the product liability legal system to deal with infringement cases caused by defective products . Product liability legal system is extremely important in a modern industrial society the legal system , and its content is also very rich . Product liability law in China has initially formed the system , played an important role in building a market economy , but there are still some inadequacies . Therefore , by referring to foreign legislative experience , systematic research on the product liability system has a very important significance to improve our product liability legislation . This paper is divided into four chapters , the first chapter of the general system of product liability law , expounded the meaning of product liability , product liability , shall be put into the marketing of the product has a defect may cause damage to the person or property of others , and the manufacture of the product special , sellers should bear tort liability. Then discusses the significance and the history of the property and systems of product liability laws . Chapter II system effects of product liability legislation in the United States and the EU situation , in order to seek to learn from on China - related legislation . The third chapter of our existing product liability legislation in the product liability legislation style , the Principles of Responsibility , product range , product defects , the main responsibility for damages profiling of the important issues for in-depth system and point out its inadequacies exist . Chapter Chapter imperfect listed at combined legislative experience in the United States and Europe , a conclusive overview of the perfection of our product liability law , and made specific improvements .
