Abstract


In the regulatory labor legal relations, the rights and obligations of the contracting parties are very clear, and there are statutory procedures therefor. But in terms of the old state-owned enterprises and various small-scale or middle-scale enterprises, there are numerous non-regulatory labor relations. And the state legislation institutions basically have not yet made any legislation on the establishment and improvement of the suspension system for labor contracts. This paper endeavors to make elaborations on the necessity of the establishment of the suspension system for labor contracts to regulate labor contract relationship from the concept of the termination of labor contracts and the evolution of legislation thereof, the necessity of the legal system for the termination thereof, the legal consequences of the termination thereof and the improvement of the legal system for the termination thereof and other aspects, so as to provide basis for the solution of numerous disputes over labor contracts in practice and have the interests of the employing entities and the laborers more balanced.
