Abstract


China 's credit card industry is a product of reform and opening up . Since the 1979 credit card entering the country in the next 30 years , China's credit card market like gangbusters camel has been developing rapidly. However, due to the establishment of our credit card mechanism and its legal system has lagged far behind the use of credit cards , operation and management mechanism has not yet been fully established , lead in practice to produce a large number of credit card disputes , especially malicious overdraft and fraudulent use of a credit card two types of the dispute is particularly prominent, increasing risks and safety hazards to the development of China 's credit card business and credit card transaction order and stability . In the face of increasingly prominent credit disputes , China's urgent need to improve the credit card legislation and establish and perfect the system of credit card transactions . Select several credit card transactions are more representative of the legal issues , the perspective of civil and commercial law , in-depth analysis of the legal relationship between the parties in the credit card transactions , credit card transactions in the presence of malicious overdraft and take with a credit card two main types of risk analysis . Finally, some suggestions to improve the legal system of China 's Bank Credit Card . The paper is divided into four parts : the first part of the Credit Card Overview \The second part of credit card transactions , the parties and their legal relationship , focusing on analysis from the point of view of Civil and Commercial Law the legal relationship between the card issuer , the cardholder , on the basis of the legal relationship between the merchants and other participants . The third part of \The fourth part of the legislative status quo of China 's credit card and its perfect , by analyzing the lack of credit card legislation , and proposed recommendations to improve the legal system of China 's credit card .
