Abstract

With the improvement of people living standards, the demand on meat, eggs, milk products is increasing, Thus the safety of livestock products becoomes the focus of the people’s attention. Veterinary drugs as inputs have played in a very significant role in the livestock-raising industry, It not only can prevent and control animal diseases, and also can promote the health of our livestock industry development. The development of veterinary drug market was in the early 60s in China, many professional veterinary drug manufacturers has only just begun to establish, the quality system of veterinary drugs has also created and developed slowly. However the regulation refers to the production, the operation and the use of veterinary drugs have not provided, which led to great confusion in veterinary drug market, and the hidden troubles about the safety of veterinary drugs has arisen. The Veterinary Medicine Administration Regulation had promulgated since 1980, the market order of veterinary drugs had been able to regulate, the number of manufacturers and the enterprises has increased every year, veterinary drugs industry has also entered a stage of rapid development. However, as the development of veterinary drugs market, many followed problems has gradually arisen. In the first place, the production and operation on counterfeit veterinary drugs was very common in the veterinary drug market, which was resulting in the death of livestock animals and the damaged of the raiser’s self-interest. In the second place, the behavior of non-standard use of veterinary drugs has also led to the risks of residue of veterinary drugs in the food of animal origin in veterinary drug market, thus is harmful to human health. At last, because many of the veterinary drug manufacturers are not in accordance with relevant regulations in China, add some pharmaceutical ingredients in veterinary drugs which may excrete by animals in the surrounding environment, that would undermine the balance of the ecosystem and the environment. Therefore, to strengthen the monitoring of veterinary drugs market, and improve the legal system of regulation of veterinary drug market, it must reform the existing regulatory regime, to achieve pattern of diversified regulation, and ensure that the legalization and standardization of regulation of veterinary drug market.A study relate to the legal issues of regulation of veterinary drug market in China is implementing in this paper, the purpose, significance, innovation and difficulty of this research have teased in the first chapter; On the base of defined concept, the second part will put some theories to explain the theoretical basis of regulation of veterinary drug market, which include the theory of safety value, order value, sustainable development value in law, and the cost-benefit theory, the theory of asymmetric information and externality in economics; Producing the legal system and regulatory system of regulation of veterinary drug market in China, and then through the investigation of veterinary drug market in the Hubei province, to analyze the legal issues of regulation in the three chapter; The fourth part is main sum up the experience of the supervision system of U.S., EU, Canada and other developed countries’ veterinary drug market, to provide a reference for our country. The fifth part of this paper is proposing countermeasures of the improvement of supervision system of veterinary drug market, includes the improvement of regulatory institution of veterinary drug market, the construction of regulatory approach with diversity of control subjects, to establish operating mechanism and safeguard measures for the regulation of veterinary drug market. In the improvement of the institution, with analysis of the existing institution from the macro and micro level, then put forward corresponding measures, especially in the accountability system of veterinary drug market, for the purpose of putting the regulators and market players on a more comprehensive and effective restraint, adding economic law responsibility into this institution. In addition, establishment of diversity of control subjects and operating mechanism in this paper, to some extent, may also improve the regulation effectiveness of veterinary drug market, thus making some contribution for the standardization as well as legal system of regulation to our veterinary drug market.
