Abstract


Many achievements since the reform and opening up 30 years of Chinese rule of law . Socialist legislative work methodically , socialist judicial system has been initially established , gradually raise the people 's awareness of their rights and the continuous development of the concept of equality . Chinese society , however , also appeared in the socialist rule of law in the process of building some moral weakening the values ??Absence egoism , and Willow doctrine , the gradual development of hedonism thinking . Why starting to prove the effectiveness of the rule of law , the moral ethos and values ??of the society and to traditional Chinese values ??require a certain degree of departure from it? Whether the establishment of a Western legal model will lead to the moral standards and values ??of the society as a whole to be sublimated it? In this paper, from the perspective of the legal and social analysis of these issues . Weakening of the rule of law by the relationship between the rule of law in China and Chinese traditional social control , the relationship between social control and traditional Chinese values ??, traditional Chinese values ??of traditional Chinese social control reaction analysis , presented in traditional society the control thus weakening the traditional values ??, as well as Western rule of law there is a certain degree of conflict directly with traditional Chinese values ??. To answer why the construction process of the rule of law in China will weaken the moral values ??missing phenomenon . Analysis of the inherent defects of the rule of law , sparked further reflection . Standing one can not bear to thousands of years of cultural history and China want to be cut off , and think a lot of good ingredients in traditional Chinese culture beyond the position of some Western thought , standing a the possibility of establishing a beyond mere Western legal model superior the position of the system , and cause people to rethink what should be the values ??of the modern Chinese society , rethink the direction and path of the rule of law in China .
