Abstract


The principle of transparency as one of the basic principles of the WTO organization to build a complete, more viable and durable multilateral trading system has a crucial role. China since its accession to the World Trade Organization, the transformation of government functions and administrative public has made certain achievements. Achievements at the same time, we must also be a clear understanding of the achievements of the requirements of the current practice of transparency in China with the WTO principle of transparency and developed countries compared, there are still some gaps. Paper, mainly through of transparency standards under the WTO framework, and on behalf of the State to implement the introduction of the practice of the principle of transparency, how to build a more transparent public administrative system to put forward their views on China. This paper is divided into Introduction, body, conclusion of three parts. The text is divided into four chapters. The first chapter is an overview of the WTO principle of transparency. Start with the concept of the WTO principle of transparency, in-depth analysis of the meaning of the principle of transparency in the WTO Agreement and the legal basis for its existence, and select some of the WTO agreements about the terms of the representativeness of the principle of transparency to be introduced to more intuitive presentation of the principle of transparency in the WTO Agreement specific requirements. Subsequently, the chapter reviews the history of the WTO principle of transparency, the details of the course of development of the principle of transparency in the WTO. The second chapter focused on transparency standards are discussed in the WTO Agreement. This chapter begins by introducing the member countries should fulfill the transparency obligations under WTO Agreement, systematic analysis of the principle of transparency in the WTO Agreement exceptions to the general standard. Subsequently, this chapter combined with the transparency principle case involving the WTO panel or Appellate Body report, the core provisions of the principle of transparency - GATT1994 10 interpretation to a more in-depth to reveal the terms of meaning and legislative intent, to further clarify standards of transparency in the WTO agreements, for better understanding and application of the relevant provisions of help. The third chapter discusses the United States, Japan's domestic law practice in fulfillment of transparency obligations. Open government information system between the two countries as the main body, and comprehensive legislation and administrative practice of these represent the country in implementing the transparency obligations, as well as the significance of these practices and implement the principle of transparency. These countries are developed countries in the rule of law, their practice can be used as the best example of the domestic law to fulfill the obligations of transparency, worthy of our country and learn from the advanced experience. Based on our current administrative public system in the fourth chapter, the challenges faced by our country in the fulfillment of transparency obligations, respectively, from the level of legislation and administrative practice reveals shortcomings in implementing the principle of transparency, and then put forward to meet this challenge of coping strategies. How to build a more transparent information disclosure system proposed preliminary thinking.
