Abstract


Subrogation system is the area of insurance law in the legal system of one of the most important countries in the world are highlighted in the insurance legislation of the system, many researchers have also done a detailed study of this system, but largely confined to the field of property insurance. In this paper, as the starting point of medical expense insurance subrogation system, medical expense insurance in his own unique nature - both life insurance and property insurance double feature, it can be applied right of subrogation in the theory and Practitioners controversial. Subrogation rights in the field of medical expenses insurance can be adopted in principle the application of the general rules of subrogation, but the application process still has its own particularity.
