Abstract


There seems not any discussion about the rational infringements on intellectual property laws issues, which means having severe intellectual property law damage behaviors and the resulting Serious losses、Violating the principles of YILI、having not Punished by laws to make up for the losses of the victim;or do not violate the direct provision of intellectual property laws and not to be identified as illegal. As privileged laws, intellectual property laws must adhere to the basic principles of balance of interests,fair and equal compensation. They were violated while there is damage but been legitimized by those privileged laws. Those infringements have violated the traditional values of YILI, which is a moral principles theory. As jurisprudences, China has not been effective in the systematic. Despite it has existed so long in China and continued to influence the legal mental culture of the People in the circle of Chinese culture.My theoretical basis is the traditional Chinese cultural "YILI" theory. Under the study at home and abroad, I attempt to tell people that the rational infringements on intellectual property law issues have no legitimate excuse to exit. At last I am willing to tell you the harm, characteristics、causes and countermeasures of it. Finally, I will discuss the governance method. Overall, the article’s theoretical systems are both on the pure legal culture and theory, and there are deep into the specific provisions of intellectual property law to find proof.The author’s conclusions are those: One, YILI principles should become the philosophical basis of the intellectual property laws; Two, the rational infringements on intellectual property laws issues have not received sufficient attention; Three, It is contrary to the original intention ,the basic principles of the balance the interests, fair and equal compensation, the legal mental culture of the Chinese Intellectual Property laws, especially contrary to the YILI principles what should be the intellectual property jurisprudence. Those principles could be the theoretical basis to further explore the rational infringements on intellectual property laws issues. In my article, I use some writing methods such as Recursive argument、Example argument、Interpretation and comparison. My conclusion is: the rational infringements have generally existed in the law world and we should pay attentions in them.In my article, I use Recursive argument、Example argument、Interpretation and Comparison writing methods to pointed out that the extensive existence and the severity infringements, so as to draw attentions of the legal profession, social circles and economic circles, or to expand the horizon of intellectual property research.The main frameworks of my article are as followsPart I:“YILI”and its relationship with the Law in History: Firstly, try to find the origin and evolution of“YILI”from the ancient China, Indian, and Western cultures, Secondly, "YILI" has been the cornerstone of the law philosophy in Japan.Part II: The rational infringements of intellectual property law theoretical analysis: I try to explain the meanings of the rational infringements and the rational infringements of intellectual property law ,its harm, characteristics and causes .Part III: Countermeasure: Including measures within the existing legal system and the treating concept in the future.Part IV: Conclusion: I give a conclusion. that is , the rational infringements of intellectual property laws is a widespread sense of "legal, legitimate damage".
