Abstract


With the rise of the Chinese economy, the RMB exchange rate continues to heat up. In recent years, the United States more and more focus on the allegations of the RMB exchange rate undervalued currency constitutes unfair subsidy for Chinese exports. The United States in order to identify the RMB exchange rate constitute unfair subsidies under the Agreement on Subsidies and Countervailing Measures, the RMB exchange rate subsidies submitted to the WTO, we must first solve two basic problems: exchange subsidies jurisdiction issues and the legal basis of the RMB exchange rate subsidies . This article revolves around two basic issues. Determine the jurisdiction of the WTO for the RMB exchange rate issue, finds that the premise of the RMB exchange rate subsidies. So I first discussed from the point of view of the procedural law of the jurisdiction of the WTO Dispute Settlement Body for the issue of RMB exchange rate subsidies. Then from the point of view of the substantive law of the RMB exchange rate does not constitute a subsidy under the Subsidies and Countervailing Measures Agreement, can not be classified into types of subsidies under the Agreement on Subsidies and Countervailing Measures. Finally, the author, for RMB exchange rate subsidies international legal issues, I put forward a the Countermeasures legal. This paper is divided into five chapters. Chapter 1 introduces the basic theory of the subsidies. Including the definition of subsidies and the norms of international law. Brief description of the contents of the RMB exchange rate regime and China's exchange rate reform in the background, and the exchange rate regime, the norms of international law. International regulatory system called the RMB exchange rate subsidies on its exchange rate subsidies. Chapter 2, mainly from the point of view of the procedural law, combined with the relevant international legal norms as well as the IMF and the WTO, the division of labor and the relationship between the jurisdiction of the WTO on RMB exchange rate subsidies countervailing issues discussed.
