Abstract


In today advocating freedom of speech , the pursuit of a fair and just open society, the news media has become an important medium for people to make their voice heard on public opinion , to obtain entertainment information , and has had a major impact on the political, economic , social , cultural and livelihood . Specific to the news media on the administration of justice , it plays the role of a double-edged sword . Properly utilized, it will be conducive to a fair remarks published , the protection of victims' rights , judicial supervision of the activities , to curb judicial corruption , promote the rule of law propaganda ; utilize properly, they will mislead the public , the legal rights of the parties concerned , to interfere with the course of justice trial , is not conducive to the establishment and improvement of China 's judicial system . Real life news media involved in the administration of justice , to interfere with the course of justice , against the rights of the parties , to mislead the public are common occurrences , the relationship between the news media and judicial issues put on the table , how to resolve the two conflicts , contributed to both harmony of doing in-depth study and discussion. The first part revolves around the news media can report on judicial activities , reported judicial activities based on where discussed . From citizens enjoy freedom of speech , these four aspects of the public 's right to information , supervision and judicial activities , the rule of law publicity and education to do the analysis to address the legitimacy of the media coverage of judicial activities . The third part through the Common Law countries, international treaties relating to the protection of the rights of the parties in the media reports and judicial activities in the civil law typical country analysis , summarize the lessons they both contradictory to solve both for our country The conflict provides valuable experience . The fourth part of the research and analysis of media over- reported judicial activities of the problems and realities of the violations of the rights of the parties , from the inside to the outside to find a way to resolve the two conflicts . Internal media focusing on the improvement of the judicial system , external focusing to strengthen self-discipline . The exposition of the four parts , to expect to deal with such problems in our judicial practice can benefit .
