Abstract


The field of rational use of the copyright system is a very important system. This is an easy controversial problem but difficult to understand. With the high-tech, particularly the rapid development of Internet technology, the traditional copyright system has been difficult to balance the rational use of the author, communicator, and the interests of users. Fair use of network technology on the formation of a huge impact and challenges of technological protection measures, such as greatly crowded network contract Accounted for the rational use of the system space. So, what to do with copyright rational use system under the network environment? How to play the function of the regulator and flat value for authors, disseminators, and the interests of users? These problems make us have to rethink this system.This article first explains the copyright and rational utilization system concept and analyzes the new challenge of rational use system under the network environment. Then, through comparative analysis, historical analysis, case analysis and induction analysis and other methods, discusses the use of domestic and foreign copyright rational utilization system of the status quo and rational use system existing problems. Finally, on the basis of discusses before, propose recommendations about the copyright fair use under the network environment, and strive to make research results to be innovative in theory, be operable in practice.
