Abstract


In recent years,colleges and universities as administrative subject’s status were leaglly recognised.Meanwhile,they also increasingly being pushed to the defendant’s desk by their own students.Legal disputes between them continues.We may easily find out the reason why there are so many contradictions happened,that is because students’rights were strongly suppressed by colleges and universities,and there was no vast space for students to develop their rights,also we know that students rarely involved in college administrative management system construction.In order to effectively avoid contradictions between colleges and students,we can start from the realization of students’rights.Making a plan about students participation of college and university affairs management is the first step.This plan must include building a strong legal effectiveness level,remedy system,and so on.All these factors could contributed to a legal framework about college students participation system.Case analysis, comparison analysis and inductive analysis were used in this paper,we also did a deep legal research about the current legal background of China’s higher education.We analysed the possbility,pertinency and validity of the students participation system.Finally,we draw a conclusion like this.we must immediately do a legal construction about this participation system,continuing to supplement students’ rights and college obligations,completing the founctions of student groups,dredging students’rights relief channels.
